In no event shall Bagalito Enterprises be liable for any damages, including, without limitation, direct or indirect, special, incidental or consequential damages, loss or expenses arising in connection with our business or use thereof or inability to use by any party, in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, malicious software, line or system failure regardless of Bagalito Enterprises and/or its representatives being advised of the possibility of such damages, losses or expenses.
• Software-related problems or bugs associated with apps are not covered under our warranty. We are not liable for any loss of data in the event of failure of your device and you’re highly advised to make use of multiple backup options including online data backup services.
• Accessories and consumables are not covered under our warranty or return policy. Please ensure that you check and verify your items upon receipt.
•Bagalito Enterprises reserves the right to refuse to honor this warranty for any of the following reasons:
- Repairs carried out by anyone not authorized by Bagalito.
- Damages caused by accidents, theft, spillage, fire damage or electrical problems at the premises where your product is used.
- Misuse of the product, malicious or accidental damage, “rooting” or “jailbreaking” of the device if such action renders the device unusable.
Use of third-party accessories not included with your device.
Pre Repair Device Conditions:
1. It is recommended to back up your device before any repair. Also, Customers are responsible for all iCloud, Google, Email and PIN Credentials. Company cannot be held liable for any data loss that may occur during a repair.
2. If the requested repair requires labour and/or parts not specified, company may seek your approval for a revised estimate.
3. All Jobs must be collected within 90 days of completion unless prior arrangement has been made. Jobs that are not collected in this period may be deemed as “Uncollected Goods” and/or may incur a storage fee. Uncollected Goods may be sold/disposed of after the required time has elapsed. Please retain your old parts for in the event of a refund all BAGALITO parts will be removed from the repaired device.
4. Liquid-damaged devices are worked on for data recovery only. We will not repair a device that has had signs of liquid damage. Liquid damage can cause problems in the future on devices due to corrosion reappearing. You agree that you do not hold company or its staff liable if your device stops working after a data recovery service.
5. When a phone is dropped, it can sometimes cause microscopic fractures in the board that may cause problems only after a board is removed or repair is completed. This may result in different problems arising.
6. If your device is brought to the company in a non-working condition and we are unable to test the device to ensure other functions are working, company will not be held liable for any other functions not working after the repair. We will notify you and you can approve or reject to repair the additional issue at additional cost.
7. All repair times given are estimates only and cannot guarantee a particular repair time frame. When parts are required we cannot guarantee delivery times as shipping is out of our control.
8. By using company service you acknowledge that your manufacturer warranty may or may not be voided and do not hold the company or its staff liable for voided warranties.
9. Once a device has been opened, the factory seal is considered compromised. Bagalito accepts no responsibility for damages caused by the compromised seal. Important Messages may appear after a repair. Face ID may not work after repair. Battery Percentages may not show after replacement.
• Bagalito Enterprises will use its best efforts to resolve Customers’ computer technical issues and problems in a professional, reasonable and timely manner, considering the circumstances and nature of the issue.
• Parts replacement and repair services can be provided by Bagalito Enterprises as necessary.
• All costs are the responsibility of the Customer
•All prices are subject to change without notice.
• Bagalito Enterprises may include an additional fee for any delivery, transport or installation of our product and services that may arise.
• Additional service done outside of the scope of work will be charged on a case-by-case basis.
• All defective merchandise must be returned in original packaging with software, cables, manuals etc.
• Bagalito Enterprises assumes no responsibility for errors, inadequacies or omissions in our service and supply of information.
• In no instance shall Bagalito Enterprises be liable to any person or company for any special, personal, general, incidental, indirect or consequential damages of any kind including without limitation, those resulting from neglect or criminal acts of third parties and loss of any kind.
• In the event that Bagalito Enterprises services are hampered negatively in any way due to acts of God, fires, floods, earthquakes, other natural disasters, national emergencies, strikes, lockouts, computer hacking, malicious computer software, any law, regulation of any government or other causes beyond Bagalito Enterprises reasonable control then Bagalito Enterprises shall be excused from the delivery or our services by such cause.
• Bagalito Enterprises reserves the right to amend and update the Terms and Conditions of Service and Policies that govern our services at any time.
• Bagalito Enterprises reserves the right, at any time at our sole discretion, to modify, suspend or discontinue the website, services, content, features, prices, services or products offered through the site without notice.
• English Language will govern any action related to Bagalito Enterprises Terms and Conditions of Service and Policies.
• Customers warrant that the information supplied to Bagalito Enterprises is correct and accurate.
• Customers shall not cause Bagalito Enterprises to participate in or contribute towards any activity that is illegal under any governing state, law, rule or regulation and you shall indemnify and defend Bagalito Enterprises from and against any harm or damages caused.
• Bagalito Enterprises, its suppliers, contractors, and anyone affiliated with Bagalito Enterprises may at any time, without notice or liability, restrict the uses of its services for any purpose.
• Bagalito Enterprises has the right to refuse a request for service at any time.
• Bagalito Enterprises Service currently is available only to residents of Trinidad and Tobago. Support may be offered to residents of other countries if users agree with the terms and conditions, applicable laws and regulations.
• The Terms and Conditions of use and policies shall be governed by the laws of Trinidad and Tobago which shall claim jurisdiction for any legal action or claim between Bagalito Enterprises and the Client.
• Customers and Bagalito Enterprises agree to the following dispute resolution procedure: In the event of any controversy, claim, action or dispute arising out of or related to any transaction of business with Bagalito Enterprises, the party asserting the dispute shall first try in good faith to settle such dispute(s) by providing written notice to the other party (by first class, registered mail or e-mail) describing the facts and circumstances (including any relevant documentation) of the dispute and allowing the receiving party thirty (30) days to respond to or settle the Dispute.
